Beytin McLaughlin was proud to again serve as a Platinum Sponsor of the Federal Society for Healthcare Risk Management and Patient Safety (FSHRMPS) Annual Conference held in Ft. Lauderdale, Florida, where shareholder Gabrielle Osborne spoke on “How to Manage the Risk of Corporate Representative Depositions.”  Also representing the firm at the conference were shareholder Alan Mirelman and partner Paul Nugent.  This is the seventh year that Beytin McLaughlin has served as a platinum sponsor, and it is our firm’s privilege and pleasure to continue to assist the hospitals and health care providers throughout the State of Florida regarding their risk management and patient safety needs.

Damien Hoffman and Paul Nugent Secure Defense Verdict on Behalf of Spine Surgeon in Wrongful Death Trial in Highlands County

Damien Hoffman and Paul Nugent obtained a defense verdict in Highlands County on behalf of an orthopedic spine surgeon following a 12-day trial which involved multiple experts from a variety of specialties. The Plaintiff alleged the patient developed a retroperitoneal bleed following lumbar spine surgery which was not timely recognized or acted upon and that the surgeon’s negligence caused the patient’s death. During closing argument, the Plaintiff asked the jury to return a verdict of $10 Million, but the jury agreed with our defense and returned a full defense verdict finding there was no negligence.

Kaitlin Rosenthal and Mindy McLaughlin Secure Significant Fifth DCA Reversal Requiring Dismissal of Multiple Counts in Wrongful Death Medical Malpractice Action

Kaitlin Rosenthal and Mindy McLaughlin, along with appellate counsel, Dinah Stein, secured a major appellate win in the Fifth District Court of Appeals, which reversed the trial court’s denial of our clients’ motion to dismiss in a wrongful death medical malpractice action and remanded with instructions to dismiss three counts outright. The Court held that the plaintiff failed to provide the presuit notice required by Chapter 766, where the corroborating affidavit addressed only the alleged clinical negligence of the physician and did not support claims for lack of informed consent or direct negligence against the practice. This decisive ruling reinforces Florida’s strict presuit screening safeguards and curbs efforts to expand malpractice claims beyond what was properly vetted before suit.
